New CycleCare plans - Terms and Conditions

These terms and conditions ("Conditions") are the terms on which Halfords supply the Halfords CycleCare Plan to you ("you"). All Halfords retail stores are participating in the CycleCare Plan in the United Kingdom and Republic of Ireland. These Conditions are integral to each CycleCare Plan and are independent of any other contract you might have with Halfords.

  1. Definitions 

  1. In these Conditions, the following definitions shall apply: 
    Benefits: means the benefits of either Classic, Enhanced, Premium and Premium E-Bike CycleCare Plan as described in clause 3 of these Conditions. 
    Conditions: the terms and conditions set out in this document as amended from time to time in accordance with clause 12. 
    Contract: the contract between Halfords and the Member for the supply of the Halfords Motoring Club to the Member. 
    Cooling-Off Period: means the 14-day period from the Start Date. 

Customer, you, your: the person who purchases the CycleCare Plan and is party to the Contract. 

CycleCare Plan: means either Classis, Enhanced, Premium, Premium E-Bike CycleCare Plan.  
Event Outside Our Control: has the meaning given in clause 11. 
Halfords Website: means the Halfords website (www.halfords.com) 
Halfords, we, us, our: means, as applicable, either Halfords Limited (company number 00103161) of Icknield Street Drive, Washford West, Redditch, Worcestershire B98 0DE. 
Minimum Term: has the meaning given in clause 4.1 of these Conditions. 
Contact Centre: means the dedicated support team situated within Halfords. 
Payment Method: means your selected payment method to pay for the Monthly Membership which must be a credit card, debit card or Paypal. 

Plan: means your CycleCare Plan. 
Start Date: means, following the process set out in clause 2, the date on which your CycleCare Plan begins. 
 

  1. In these Conditions, the following rules apply: 
     

  1. A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality). 
    (b) A reference to a party includes its personal representatives, successors or permitted assigns. 
    (c) Any phrase introduced by the terms including, include, in particular or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms. 
    (d) A reference to writing or written includes e-mails. 

  1. Customers will be eligible for a CycleCare Plan in the following scenarios:  

  1. The Plan is brought together when purchasing a new or second-hand bike from Halfords. 

  1. The Plan can be brought for a Customer’s existing bike that has not been purchased from Halfords.  

  1. Clause 2 (b) is subject to the following:  

  1. If the CycleCare Plan has been purchased via Halfords Website, then the Customer is required to go in store to activate their CycleCare Plan by providing their CycleCare Plan receipt and their bike in store. If the Customer is unable to take their bike in store the Customer must confirm the bike’s make, model, colour, and frame size. Any failure on the Customer’s part to provide the correct details invalidates their CycleCare Plan.  

  1. If the CycleCare Plan has been purchased in store and the Customer does not have their bike on their person then the Customer must confirm the bike’s make, model, colour, and frame size or otherwise the Customer can take their bike in store so this information can be obtained. 

  1. The sale of a Plan by Halfords is subject to the following eligibility criteria: 

  1. Serviceable bikes: Bikes that are determined to be beyond repair and unsafe to ride, as assessed by a qualified technician appointed by Halfords, will not be eligible for the Plan.  

  1. Unmodified bikes: Bikes that have been altered or modified in a way that renders them unsafe or illegal, as determined by Halfords, will not be eligible for the Plan. 

  1. Repairable bikes: The availability of bike parts is essential for providing comprehensive Benefits under any Plan. In rare cases, for unusual or uncommon bikes, Halfords may not be able to obtain replacement parts necessary to fully provide all the benefits of a Plan. In such instances, those specific bikes may be exempt from the Plan.  

  1. If a CycleCare Plan has been purchased in accordance with clause 2 (b) and the bike does not meet the eligibility criteria in clause 2 (d) Halfords will provide you with a refund and terminate your CycleCare Plan.  
     

  1. The Contract and your Benefits 

  1. When you place an order for a Plan on the Halfords Website, our acceptance of your order will take place as soon as we process your payment at which point a contract will be entered into between you and us and we will also send you an email confirmation. In order to claim your Benefits you must provide your name and contact details in store. For support in purchasing your Plan, please contact the Contact Centre.

  1. Fees and Payment  

  1. Subject to which CycleCare Plan you purchase you agree to pay the cost of the CycleCare Plan upfront or to make payment for your Plan through Klarna Bank AB (publ) (“Klarna”), an independent third-party payment service provider. By selecting the Klarna payment option, you agree to enter into a separate contractual relationship with Klarna, subject to Klarna’s terms and conditions.  

  1. Once you select a payment frequency, this cannot be changed during the Minimum Term.  

  1. Subject to clause 4(f) below, the prices above are subject to change at the sole discretion of Halfords.  

  1. Customer cannot move between the different types of CycleCare Plans available. 

  1. Should you wish to change your Payment Method, you will need to contact the Contact Centre. 

  1. Failure to use your CycleCare Plan or your Benefits does not relieve you of responsibility for payment. In addition, there are no refunds on amounts paid for any CycleCare Plan except as set out in clause 6. 

Klarna  

  1. By choosing the Klarna payment option, you authorise Klarna to process payments on your behalf for the purchased Plan. Halfords shall not be responsible for any payment-related matters, including but not limited to payment processing, repayment terms, interest rates, or any other financial arrangement.  

  1. Halfords shall not be liable for any delays or issues related to Klarna payment option, including any delays in processing payments, technical difficulties, or issues arising from Klarna’s services.  

  1. Halfords reserves the right to discontinue or modify the availability of the Klarna payment option at any time without prior notice. In the event of such changes, Halfords shall not be liable for any inconvenience or loss experienced by you.  

  1. All Klarna payment options are only available if your billing address is in the United Kingdom.  

  1. When Paying with Klarna, your transaction and payment card details are collected and processed by Klarna and you will agree to Klarna’s user terms and terms and conditions and Klarna’s terms and conditions. Your personal data is handled in accordance with applicable data and protection laws and in accordance with the information in Klarna’s privacy statement. 

  1.  

  1. Term  

  1. The minimum term of your Plan is either twelve (12) months or thirty-six (36) months from the start date depending on which Plan you have purchased (the “Minimum Term”).  

  1. Your Plan may not be cancelled or terminated by you during the Minimum Term except as set out in the “right to cancel” section below.  

  1. Thirty (30) days prior to the expiry of the Minimum Term you will receive an email notifying you that your Plan is going to terminate, and there will be a link to purchase another Plan.   

  1. At the end of the relevant Minimum Term, you will no longer by entitled to any of the Benefits that are included in your Plan.  

  1. Right to cancel  

  1. Provided you have not used any of the Benefits during any Cooling-Off Period you can cancel your Plan and receive a refund by contacting the Contact Centre.  

  1. For the avoidance of doubt, if you have used your Benefits during the Cooling-Off Period before contacting us to cancel your Plan, or if you attempt to use your Benefits after contacting us to cancel your Plan, you will not be entitled to cancel your Plan and you will be liable to pay us the remainder of the fees due for the Plan. 

  1. If you become unable to ride a bike due to a permanent physical disability or medical condition, you shall have the right to terminate your Plan by providing thirty (30) days written notice to the Contact Centre. Halfords reserves the right to request reasonable verification or clarification of the disability or medical condition from a qualified medical professional.  

  1. In the event that your bike is stolen during the coverage period of your Plan, you shall have the right to terminate your Plan by providing thirty (30) days written notice to the Contact Centre. Your written notice must clearly state a valid and official police crime reference number associated with the reported theft of your bike. 

  1. Halfords will review the circumstances of the termination and, if appropriate, refund a pro-rata portion of the fees paid by you for the remaining unexpired term of the Plan. However, Halfords will deduct an admin fee of £15.00 for any refund provided to you.   

 

  1. Insurance  

  1. Subject to the type of Plan you have purchased, one of the benefits includes a discount of up to 45% on the total premium for the first year of the policy only from Ripe Insurance Ltd (“Ripe Insurance”). To qualify for the discounted bike insurance, you must have purchased the Plan from us, be a UK resident who is not a professional cyclist.  

  1. The E-Bike insurance includes a discount of up to 45% on the total premium for the first year of the policy only. To qualify for the discounted E-Bike insurance, you must have purchased the Plan from us, be a UK resident who is not a professional cyclist. The E-Bike must be driven by human pedal power or electric battery with a motor output not exceeding 250w/15.5 mph. The discounted E-Bike insurance does not include any electric bicycle where the power or speed requires it to be registered, insured, or taxed as a motor vehicle. 

  1. This insurance benefit is not available to customers who have purchased their Plan in the Republic of Ireland.  

  1. After thirty (30) days from the date of your Plan purchase, an email will be sent to the email address provided by you during the purchase process. This email will contain a unique link that will direct you to the website of Ripe Insurance offering the discounted bike insurance.  

  1. By clicking on the link provided in the email, you will be redirected to Ripe Insurance’s website, where you can review the insurance options and redeem the discount. You accept that by redeeming the discount and proceeding with the purchase of the bike insurance policy, you acknowledge and agree that the contract for the insurance policy will be between you and Ripe Insurance. Halfords are not party to the insurance contract and do not assume any liability or responsibility for the insurance policy or its coverage.  

  1. The link to redeem the discounted bike insurance will be valid for thirty (30) days. It is your responsibility to access and redeem the discount within the stated timeframe.  

  1. The discounted bike insurance is subject to the terms and conditions set by Ripe Insurance. Any concerns, issues, or claims related to the insurance policy should be directed to Ripe Insurance offering the policy.  

  1. The availability of the discounted bike insurance is subject to Ripe Insurance’s discretion and may be subject to change or withdrawal without prior notice. Halfords do not guarantee the availability of the discount for the entire duration of the Plan.  

  1. Benefits, Use and Exclusions

  1. The Halfords locations at which Benefits can be used, subject to any other restrictions set out in these Conditions, is any Halfords retail store based in the UK and in the Republic of Ireland.  

  1. To use your Benefits in a Halfords retail store you must provide your name and contact information. For security, we may ask additional questions to ensure that only the person registered in the Plan is using the Benefits. 

  1. In the event that you wish to obtain a refund for your use of a Benefit(s), you need to contact the Contact Centre. 

Fair Usage 

  1. Your usage of the Benefits will be subject always to fair use as set out below. 

  1. Benefits can only be used by the person and the one bike registered for the Plan. For the avoidance of doubt, sharing your Plan is a breach of these Conditions and any attempted use of a Plan by someone other than the person registered to the Plan will result in your Plan being frozen and you will not be entitled to use any other Benefits. 

  1. Benefits cannot be sold, loaned or given away to or used by a third party. A benefit will automatically become void without a refund if sold, loaned or given away or if any attempt is made to sell, loan or give it away. 

  1. Benefits cannot be used in conjunction with any offers or discounts offered by third parties including but not limited to “Blue Light” discounts. 

  1. Benefits are subject to availability and the Plan does not entitle you to priority booking. You should book Benefits instore early to avoid disappointment. 

  1. Your CycleCare Plan will be revoked if: 

(a) you are found to be guilty of fraud or attempted fraud in respect of your Plan; 
(b) in the reasonable opinion of Halfords, there is misuse of the Plan in breach of these Conditions of any kind; or 
(c) in the reasonable opinion of Halfords, there is any inappropriate conduct at a Halfords retail store. 

  1. For the avoidance of doubt, inappropriate conduct means, without limitation, causing any security or safety concerns, displaying any sign or visible representation of any kind which is, or could reasonably be judged to be, threatening, abusive or insulting to any member of Halfords staff and/or other members of the public in a Halfords property or mobile location. 

  1. The CycleCare Plan is for personal use only; business use is strictly prohibited and constitutes a breach of these Conditions. Halfords reserves the right to determine whether a transaction constitutes business usage. 

  1.  Liability 

  1. If we fail to comply with these Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this Contract. 

  1. Except where expressly stated otherwise and agreed in writing with you, we only supply the Goods or Services for domestic and private use. You agree not to use the Goods for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

  1. We do not in any way exclude or limit our liability for:  

  1. death or personal injury caused by our negligence. 
    (b) fraud or fraudulent misrepresentation. 
    (c) any breach of the terms implied by section 9 to 11, or 17 of the Consumer Rights Act 2015; and 
    (d) defective products under the Consumer Protection Act 1987. 

  1. Events Outside Our Control 
    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. 

  1. Variation 

  1. Halfords reserves the right to vary these Terms by giving You no less than 30 days’ written notice of such variation via email and by making note of such changes available on the terms and conditions page of the website at https://www.halfords.co.uk/information/terms so please review the website periodically for changes. 

  1. Communications between us 

  1. Any notice or other communication given to you under or in connection with the Contract shall be in writing (including email), addressed to you at the address that you have specified to us in writing in accordance with this clause, and shall be delivered personally, sent by pre-paid first-class post, recorded delivery, commercial courier, fax or e-mail. 

  1. A notice or other communication shall be deemed to have been received: if delivered personally, when left at the address referred to in clause 15.1; if sent by pre-paid first class post or recorded delivery, at 9.00 am on the second Business Day after posting; if delivered by commercial courier, on the date and at the time that the courier's delivery receipt is signed; or, if sent by fax or e-mail, one Business Day after transmission. 

  1. The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action. 

  1. Other Important Terms 

  1. We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Conditions. 

  1. You may only transfer your rights or your obligations under these Conditions to another person if we agree in writing. 

  1. This Contract is between you and us. No other person shall have any rights to enforce any of its terms. 

  1. Each of the clauses of these Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect 

  1. If we fail to insist that you perform any of your obligations under these Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. 

  1. These Terms are governed by English law. This means a Contract for the purchase of goods through our Website and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland. The only language in which the Contract can be concluded is English. 

  1. Provision of Data and Halfords Processing 

  1. Halfords will process Personal Data in accordance with our Privacy Statement, which can be found at https://www.halfords.com/customer-services/policies-and-regulations/privacy-policy.html.
